Terms & Conditions
CHAPTER 1: GENERAL PROVISIONS
Article 1: Application of agreement
The Rental Agreement (“Agreement”) is entered into between M2M Jom Travel Sdn Bhd. (“M2M”), and the person whose name and particulars are as set forth in the “Renter Information” segment of the Agreement (“Renter”). M2M and the Renter shall hereinafter be jointly referred to as the “Parties”, and individually as a “Party”.
The Renter is desirous of hiring the vehicle, the particulars of which are as set forth in the “Vehicle Information” segment of the Agreement (“Rental Vehicle”), from M2M, and M2M has agreed to let the Rental Vehicle to the Renter, subject to the terms and conditions as follows.
M2M may make special provisions as long as they do not violate the purport of this Agreement, laws and regulations, administrative issuance, and common practice. If a special provision is made, such provision shall take precedence over this Agreement.
CHAPTER 2: RENTAL
Article 2: Renter and Guarantor
If the RENTER or GUARANTOR (emergency contact/person in charge) breaches any of the terms and conditions, action will be taken to blacklist (CTOS) BOTH PARTIES and a management fee will be imposed for compensation, or any losses occur to M2M’s rental car.
Article 3: Standard Rental Qualification
M2M reserves the right to refuse any rental, at their discretion, or should the Renter not meet any terms and conditions of rental before or during the rental period. Should M2M find out that the renter carries out any illegal activities or has a previous criminal history, M2M reserves the right to collect our car back without renter’s consent. In addition, M2M have the right to terminate the rental agreement and charge the renter any penalty, cost or losses, damages will be borne by the Renter absolutely.
Should the Renter be a person in charge or representative of a company, both parties (the Renter and the company) will be fully responsible and liable for any cost incurred including but not limit to any loss, damage, which happens during rental with M2M.
Article 4: Requirement on a Valid Driving License
The Renter must be between the age of 21 and 60 years old.
The Renter must possess a valid local driving license or international driving permit with qualified driving experience of at least one year. Probationary license holders will not be accepted.
For Malaysian:

For Non-Malaysian:
Driver’s passport.

Foreign driving license with a letter validation from embassy.

Article 5: Collection and Delivery
For delivery or collection out of business location, an additional charge per way may be imposed, depending on distance, accessibility of the destination and time. Details on the charges and procedures will be made available at the time of inquiry. Any changes of agreed location in the first place, extra charges will be charged. The Renter hereby irrevocably agrees and authorizes M2M to deduct any chargeable amount from the Deposit and/or to charge the payable sum on the Renter’s payment card.
If M2M agree to a delivery, this will be stated in the Renter’s rental agreement. M2M will charge a fee for delivering the vehicle. If the Renter chooses to have the vehicle delivered, the Renter must be present at the delivery location during the requested delivery period. The same process implies picking up charges if the Renter chooses to return the car to the Renter agreed place. If the Renter does not meet the requirements in these contracts, then M2M may refuse to deliver the vehicle to the Renter.
In any condition, the Renter chooses to change the location from the original agreement; additional costs may be incurred depending on the new required location. In such an event, M2M has the right to charge the Renter payment card for any additional amount that will be incurred. The Renter must give M2M at least 3 hours’ notice to organize the delivery. M2M may be able to deliver at shorter notice, but the Renter will need to check with the Reservation Team. Pickup and delivery shall only be within klang valley area.
Late pickup/drop off:
• 30 minutes grace period will be given to pickup/drop off, following original booking times.
• In the event of late pickup/drop off, later than 30 minutes, a late charge will be imposed as following.
• From 30 minutes to 3 hours, a late charge of RM150 will be imposed.
• Pickup after 3 hours onward, vehicle will be taken back, and full amount will be charged. For drop off, another full day charge will apply.
Article 6: Speed Limit
Please drive carefully and obey traffic rules. Penalty will be imposed if the Renter do not obey the traffic rules and the Renter are fully accountable for all parking fees, traffic fines or summonses incurred. M2M reserve our right to charge adminstrative surcharges of RM50 for each case.
Article 7: Driving Restriction
M2M vehicles cannot be driven into Singapore, Thailand, Brunei and Indonesia. Subsequently M2M vehicles are prohibited from being loaded onto other modes of transportation via sea, river and air for usage from mainland to Langkawi, Tioman, Redang, Pangkor island etc.
Article 8: Vehicle Condition
Upon returning, the car has to be in the same condition as when it was delivered. Falling which, the Renter will be fully liable for the cost and expenses of restoring the vehicle to its original condition.
CHAPTER 3: PAYMENT
Article 9: General terms
M2M accepts the following payment method Online Transfer and iPay88 through M2M website booking. From January 2020 onwards, M2M is going on fully cashless payment. Cashless payments are all payments made without need of physical money. Cashless payments are made by transferring money electronically (typically bank transfer or payment card payments).
Certain Payment Instrument companies charge their member banks a fee for processing “foreign transactions”. If the Renter makes card transactions and the recipient uses a bank located in a different country other than the bank which issued the card, an international service assessment, cross-border transaction fee or similar fee may be charged. The Renter issuing bank may or may not pass this fee on to the Renter (the card user). Please contact the issuing bank for details as this is outside the control of M2M Companies.
In the event of Payment Instrument fraud or unauthorized use of the Payment Instrument by third parties, the Renter should contact the bank or card issuer immediately upon becoming aware of such unauthorized use. If the Renter suspects an unauthorized or fraudulent booking was made via M2M, please contact our Customer Service team immediately.
IMPORTANT
In order to make a booking, the renter must be over 21 years old (or such other age at which majority is reached in the renter country or territory) and have the full legal capacity to make the transaction (or have the authorization to do so from the renter legal guardian). The renter undertakes that the credit or debit card that are using is the renter owns or that the renter are authorized to complete the booking with this card and that there are sufficient funds to cover the cost of the transaction. The renter accepts financial responsibility for all transactions made under the renter’s name or account.
Article 10: Acknowledgement
The Renter hereby irrevocably undertakes that the details that the renter provided to M2M with in making a booking are fully correct. M2M Companies reserve the right not to accept certain Payment Instruments. M2M may add or remove other payment methods at its sole discretion. For increased convenience, M2M now also offers the option to have the Payment Instrument details securely stored on file.
M2M has stringent fraud detection and prevention mechanisms in place. In certain cases, M2M may require additional information or verification to validate and confirm the booking, as explained in more detail on the Site. Reservations are not confirmed until the renter has received a confirmation mail with a voucher, and it is possible that a booking could become fully booked during the fraud check, in which case the reservation will no longer be available. M2M can never be held liable in such cases. Additional information submitted will be treated in line with strict industry standards to protect privacy, using encryption for transmission and specialized agents for verification. If the renter chooses not to submit the additional information or if M2M are not satisfied with the information received, the booking will not be completed and fully cancelled, and any amounts charged (including the verification charge where applicable) will be refunded.
Article 11: Payment Condition
The Renter must make full payment to M2M’s bank account before car collection or pick up. The Renter may choose to pay through iPay88 payment gateway on M2M website or bank transfer to M2M bank account with proof and verification from M2M staff. The Renter will receive confirmation of booking upon payment received by M2M.
Article 12: Consent for Full Authorization
To complete payment for such prepaid rental bookings, delivery charge , pickup charge or any other charges whichever is applicable, the Renter hereby irrevocably agreed and authorize the applicable M2M Companies to charge credit or debit the renter Payment Instrument for the full price (sometimes without any option for refund depending on the Rental’s booking conditions, see below) upon reservation and confirmation of the booking, at the future point in time communicated in the confirmation email.
To complete payment for such post-paid charges such as defects, summons, cost and any other charges whichever is applicable, the renter authorizes the applicable M2M Companies to charge or debit the renter Payment Instrument for the full price. Please ensure that the renter Payment Instrument is valid and has sufficient credit on the future payment date. If the Payment Instrument cannot be charged on such a date for whatever reason, M2M have the right to invoice the renter manually and require the renter to pay in full.
Article 13: Word About Failed Payment
For a variety of reasons, payment on the site may fail. In such cases, M2M will offer the renter alternatives to ensure the renter reservation can go ahead. If the renter has any questions, please contact our Customer Service department.
CHAPTER 4: RESPONSIBILITIES
Article 14: Extending the Rental
If the renter want to extend the rental, please contact M2M as soon as possible. At the latest, this should be done before the end date and time on the rental agreement. M2M may or may not grant an extension or decline to grant it for the entire period the Renter requests, in M2M’s sole discretion.
Extra days will be charged at “pay at location” prices subject to number of days the renter wants to extend the rental. The renter full authorization will be updated to include any anticipated additional cost-and the renter will need to use the same payment card the renter used for the original full authorization. The renter may need to go into the rental location to sign a new rental agreement and/or provide an additional payment card for the full authorization.
If the renter failed to return the vehicles and the renter are more than 3 hours late returning the vehicles, the rental will be extended, and the renter will be charged an extra day’s rental at current pay at location prices plus a late-return processing fee for each day of part of a day until the vehicle is returned.
If the renter fails to return the vehicle to M2M at the agreed date, time and specified location, the renter will have breached the contract with M2M, and the deposit will be forfeited. This means the renter will need to show that the damage, loss or theft occurred before the agreed return date if the renter wishes to benefit from these waiver and protection products. M2M will take steps to find the vehicle and get it back. This could include reporting the vehicle to police as missing or stolen, giving the details to a repossession agency and/or third party to recover the vehicle from the premises. M2M then will proceed to charge the renter payment card on the daily basis rate.
If the renter fails to return M2M vehicle at the agreed time and date, the renter will also have to pay:
• The full cost of recovery
• Loss of rental income M2M incur.
• Costs M2M must pay third parties in relation to the vehicles.
• Our own reasonable costs, including a late return processing fee.
• Any solicitor’s cost if any debt remains outstanding and legal action shall be commenced by M2M.
The Renter hereby irrevocably agrees and authorizes M2M to deduct any chargeable amount from the Deposit and/or to charge the payable sum on the Renter’s payment card.
Article 15: Vehicle condition such as minor and major defects, interior and/or exterior
All our vehicles have been maintained in accordance with the manufacturer’s recommended standards and will be roadworthy at “pick-up”. Any existing damage, other than minor defects/damage will be stated in the contract.
Minor defects referred to as per mentioned under clause accident, damage and other charges are applicable. The Renter’s pre-authorization will be updated to include any anticipated additional cost and the renter will need to use the same/alternative payment method with sufficient funds on it. The renter may need to go into the rental location to provide an additional payment method for the pre-authorization.
The renter undertakes that the details the renter provided M2M with in making a booking are fully correct. M2M Companies reserve the right not to accept certain Payment Instruments. M2M may add or remove other payment methods at its discretion.
CHAPTER 5: ACCIDENT, DAMAGES, SUMMON AND FINES
Article 16: Minor and major accident
Should the Renter intentionally or unintentionally cause any damage to the vehicle, Renter is always liable to pay the repair, restoration and replacement costs.
The Renter must notify M2M immediately within 24hours if the vehicles have been involved in an accident or damaging event, even if no third party was involved. If the vehicle(s) is/are lost, stolen or damaged, the renter must the extent the law allows, pay the excess stated in this rental agreement, any taxes or our damage or theft processing fee
Article 17: Prohibited Acts
The Renter is always liable to pay for the compensation of M2M’s losses or full cost of repairing, restoring damages, which is estimated based on the number of days to have M2M vehicles repaired. Rental rates are subject to M2M review and approval.
The renter will also be liable to pay M2M (The Company):
• The full cost of recovery
• Loss of rental income M2M incur.
• Costs M2M must pay third parties in relation to vehicles.
• Our own reasonable costs, including a late return processing fee.
• Any solicitor’s cost if any debt remains outstanding and legal action shall be taken.
• The renter must advise M2M with a properly completed incident record, including the contact details of other parties involved, within 24 hours of the accident.
Article 18: Summon and Fines
Starting From 1st January 2020, For AES Summon Issued by JPJ (Jabatan Pengangkutan Jalan), Summons penalty charges fixed at amount of RM300 and management penalty charges amount of RM200 will be imposed should the Renter found guilty of such offences. M2M reserves the right to claim compensation or losses due to AES summon without prejudice.
CHAPTER 6: CHARGES AND ADDITIONAL FEES
Article 19: Delivery and Pickup Fees
For delivery or collection out of business location, an additional charge per way may be imposed, depending on distance, accessibility of the destination and time of day. Details on the charges and procedures will be made available at the time of inquiry. Any last-minute changes of agreed location at first place within 3 hours before the renter pickup or delivery, extra charges will be charged. When the renter signs the rental agreement, the renter gives M2M full authorization to do this. M2M have the right to charge it to the renter’s payment card.
Article 20: Other Fees
• Failing to Notify M2M of any Damages in Vehicle and Accidents involving Vehicle
– RM 100 penalty and suspension of account.
• Parking Vehicle in a Prohibited Area
– RM 150 penalty plus any applicable fines.
• Excessive Cleaning Required (Exterior and Interior)
– Minimum RM 100 penalty.
• Traffic and Parking Violations
– Full payment of fines + RM50 service fee + 10% interest per month late in payment.
• Child seat – RM30 per day, with a maximum rate of RM150 (with 6% service tax) pre booking required. Missing/damage to the child seat will result in a fine of RM300.
• Authorized driver – RM100 per driver up to a maximum of 2 (total 3 drivers)
• GPS navigator
Any faulty unit should be immediately informed of M2M for a replacement unit. No refund would be given if feedback upon return of vehicle.
The following prices will apply in case of:
1. Missing/damaged Satellite Navigation unit: *RM600.00
2. Missing/damaged Vehicle Power Cable: *RM160.00
3. Missing/damaged Suction Cup/Cradle: *RM180.00
* The above rates and prices are subject to a 6% service tax.
IMPORTANT WARNING
If M2M receives an order to pay the abandonment fine provided in the Road Traffic Act and M2M remits such payment, or if M2M incurs expenses required to locate the Renter or the Driver or remove, store, or pick up the Rental Car, or if M2M is restricted from using (prohibited from driving) cars by the authority, M2M may demand the amount stated below from the Renter (hereinafter referred to as “Expenses Related to the Parking Violation”). In such a case, the Renter shall pay the Expenses Related to the Violation by the deadline specified by the M2M.
Amount equivalent to the abandonment parking fine.
Parking violation penalty fee prescribed separately by the M2M.
Expenses required to locate, remove, store, or pick up the vehicle; and
Compensation for loss of business operation due to restriction on using (prohibition of driving) cars specified separately by M2M.
• Over-speeding >= 130 KM/hr
– Full number of fines imposed and RM50 penalty.
• Over-speeding >= 150 KM/hr
– Full number of fines imposed and RM 100 penalty.
Failure to Notify M2M of Any Miscellaneous offences; up to RM 1000 penalty and suspension of account.
CHAPTER 7: MEASURES FOR ACCIDENT AND THEFT
Article 21: Handling of Accidents
Immediately inform M2M of the details of the accident. When an accident involving the Rental Car occurs during the rental period, the Renter shall take measures provided for in laws and regulations and shall handle the situation in accordance with the provisions below regardless of the seriousness of the accident.
Promptly submit documentation or evidence required by the M2M in relation to the accident. Obtain prior approval from the M2M when settling or reaching agreements with a third party in relation to the accident; and do not carry out repairs; the Rental Car shall be repaired by the M2M
Article 22: The Renter’s Responsibilities
The Renter accepts responsibility to repair, restore and/or to change to new original parts of the vehicle at current market price plus labours for any items/parts/accessories that are damaged, lost or stolen during the period of Hire.
In such event, Renter’s deposit shall be utilized to cover such costs. The possibility of such incident would be as follows: –
• scratches on the car body which must be re-painted.
• minor or major damaged on all front & rear lamps
• broken / smash windshield, window glass & wiper.
• damage to the undercarriage and/or underbody damage that is not attributable to a collision with another vehicle
• damaged car seats (e.g. Cigarettes burn marks, stains, etc.)
• fender & bumper bend or fall out.
• any missing & damaged items relating to the car.
• damage accessories or vehicles’ part
Renters must always make sure the vehicle’s water temperature is always at a normal level. Should the Renter encounter water heating or the temperature rise, stop the car immediately at a safety area and contact our response team. For long distance driving, Renters must regularly check the water level and add water if needed and engine oil of the rented vehicle.
Failure to inform M2M of any damage or potential damage may results in suffering a breakdown, such as major damage to the engine, transmission and suspension. The cost of repairing will be the Renter’s full responsibility.
In the case of major damage happening to M2M cars(s) that require M2M to claim compensation from the Insurance Company, then the time spent on claiming from the Insurance company and sending for repairs would have resulted in losses to M2M.
The accident or damage only applies for collision between two moving objects. Any damage while the vehicle is stationary will be under the Renter’s full responsibility.
Article 23: Liability for Compensation
When the Rental Car cannot be used by the M2M due to an accident, breakdown, or other grounds attributable to the Renter or the Driver during the rental period, the Renter shall pay the M2M the fees separately prescribed by the M2M as compensation for business interruption for the period the Rental Car cannot be used or the repair period.
In addition to those provided for in the preceding paragraph, the Renter shall assume liability for compensation for damages if the Renter commits acts in violation of the Article, rules, and special provisions under this Agreement, and other terms and conditions. The Renter shall also be liable for compensation for damages when a third party or the M2M has suffered damages following use of the Rental Car due to whatsoever reasons attributable to the Renter.
Article 24: Collision with Third Party
Should the Renter meet with an accident and be hit by the third-party driver, the Renter must inform M2M immediately. In any condition that the car cannot be driven, damaged and may result in a suffering breakdown, there will be no replacement car provided to the Renter. However, should the Renter wish to have a car replacement, Renter must agree to bear all cost of replacement including new rental car, delivery charges or any other cost applied to M2M for delivering the car to the Renter.
In such event, the accident penalty will not be imposed only and if the Renter did not find guilty of making such an accident to happen with the third-party driver. This clause is only valid and applicable when the police result report shows that the Renter is not found guilty of such offences.
Article 25: Loss of Use
M2M has the right to claim compensation of the losses of future revenues when an accident disables a vehicle. The Renter is always liable to pay for the compensation of M2M losses which are estimated based on the number of days to have M2M vehicles repaired. Rental rates are subject to M2M review and approval.
CHAPTER 8: MEASURES FOR WINDSCREEN DAMAGES
Article 26: Windscreen Damages
Windshield damage happens to the windscreen (star, crack and chips), which includes door windows, rear window, and windscreen. Should Renters intentionally or unintentionally cause damage to the windscreen, Renters are always liable for all costs of replacing or repairing windscreen to the original condition.
Major crack, star or chips:
Should the Renter intentionally or unintentionally cause major damage to the windscreen including front mirror, rear driver side window, left rear window or back mirror, M2M reserves the right to charge the Renter full cost of replacing the new windscreen.
Minor crack, star or chips:
Should the Renter intentionally or unintentionally cause minor damage to the windscreen including the front mirror, rear driver side window, left rear window or back mirror, Renters are always responsible to inform M2M’s support team immediately. All cost of replacing or repairing the windscreen back to its original condition will always be the Renter’s responsibilities. M2M will advise the Renter on the cost of damages once M2M are satisfied with the cause of the incident. Failure to inform M2M may result in additional penalty charges.
CHAPTER 9: CANCELLATION AND REFUND
Article 27: Reservation Cancellation
M2M require 7 days cancellation notice prior to the Renter scheduled rental date, otherwise M2M will charge the Renter a cancellation fee as below.
1. Normal operation season:
• Full refund of the reservation payment if the renter cancels or makes any changes 7 days prior to the scheduled rental date.
• 50% of the total amount of the renter reservation payment will be charged if the renter cancels or makes any changes from 3 to 6 days prior to the scheduled rental date.
• 100% of the total amount of the reservation payment will be charged if the renter cancels or makes any changes 3 days (72hours) before the renter scheduled rental date or no show on the arrival date.
2. For peak season and festive (applicable to all Public Holiday in Malaysia):
• 100% of the total amount of the Renter reservation payment will be charged if the Renter cancels or makes any changes within seven (7) days prior to the scheduled rental date.
• For a full refund and 50% cancellation charges, the Renter is always liable for any payment transaction fee that may be incurred for refund processing.
For promotional code or voucher code payment:
Kindly be reminded of that promotional code or voucher code which is offered from time to time to selected customers only. Should the Renter have made partial (50%) or full payment, 100% of the total amount of the renter reservation payment will be charged if the Renter cancels.
A management charge might be charged for each transaction fee. These charges may vary depending on the country and current foreign exchange rates. M2M will advise Renter on charges following current exchange rates.
For any refund, M2M will only use remittance transfer to bank account submitted and authorized by the Renter.
Article 28: Refunds
M2M Companies will process refunds, if and when applicable, within a reasonable time frame. The Renter hereby authorizes the crediting to the Renter’s Payment Instrument in case of reversals, refunds, or adjustments through the service, which facilitates the processing of payment transactions. Refund process may take 7-21 working days depending on the beneficiary bank process.
CHAPTER 10: RETURN
Article 29: Responsibilities to Return the Rental Car
The Renter or the Driver shall return the Rental Car to the M2M at the specified return location by the end of the rental period.
When the Renter or the Driver has violated the preceding paragraph, the Renter shall pay compensation for all damages incurred by the M2M, in addition to paying the surcharge prescribed in the following paragraph.
When the return time specified at the time of concluding the Rental Agreement has passed, the Renter shall pay the surcharge prescribed separately by the M2M, refer to Article 5; provided, however, that this shall not apply when extension procedures have been undertaken prior to the expiration of the rental period.
Article 30: Checks Upon Return
The Renter or the Driver shall return the Rental Car in the same condition as at the time of commencement of the rental to the location specified in the Rental Agreement in the presence of M2M. Except in cases of deterioration due to normal daily use, the Renter shall be liable for the expenses required to restore the Rental Car to the same condition as at the time of commencement of the rental if the Rental Car has been defaced, damaged, fixtures have been lost, or offensive smells remain (as a result of smoking or other possible causes), etc. for reasons attributable to the Renter or the Driver, refer to Article 22
In addition to those provided for in the preceding paragraph, when returning the Rental Car, the Renter shall promptly inform M2M of any abnormalities discovered in the Rental Car.
When returning the Rental Car, the Renter shall, at his/her own responsibility, confirm that there are no items left behind (hereinafter referred to as “Items Left Behind”) in the Rental Car that belong to the Renter or passengers.
If there are any outstanding other fees, the Renter must complete its payment by the time the Rental Car is returned.
In addition to those provided for in the preceding paragraph, when the Rental Car is returned and the tank is not filled with fuel such as gasoline or diesel (in other words, does not have a “sufficient tank”), at least 2/5 tank, the Renter shall immediately pay M2M a refueling fee calculated according to the conversion table prescribed by M2M in accordance with the distance traveled.
Article 31: Handling of Items Left Behind
The Renter shall be fully responsible for confirming that there are no Items Left Behind in the Rental Car when returning the Rental Car.
M2M shall not be obligated to check for any Items Left Behind in the Rental Car, the Renter shall assume responsibility for damages incurred by the Renter, passengers, or other third parties as a result of Items Left Behind.
1. When Items Left Behind are recovered from the Rental Car, M2M shall handle the items in accordance with the following items: provided, however, that Items Left Behind that have no property value and are difficult to store on a continuous basis may be disposed of immediately and not in accordance with the following items.
2. Items Left Behind that have no property value, or items which are in danger of spoiling, are dangerous, or are difficult to be stored on a continuous basis, shall be stored for three (3) days including the day the items have been recovered, and shall be disposed of if their owner does not apply to collect them during such period.
3. Driver’s licenses, passports, credit cards (including ETC cards; the same shall apply hereinafter), coins, banknotes, documentary stamps, postage stamps, securities, tradable coupons, precious metals, mobile phones, and precious stones shall be formally handed over as lost property to the police station with jurisdiction; provided, however, that when they are not accepted by the police, the items shall be stored for three (3) months from the day the items have been recovered; and if the name and address of the owner are identified during such period, then such owner (issuing company in the case of credit cards) shall be notified to collect the items. Such items shall be disposed of when, during the three (3) months from the day on which the items have been recovered, the name and address of the owner are not identified, or the owner has not applied to collect the items.
4. Guns, swords, drugs, or other items for which ownership is prohibited by law shall immediately be formally handed over to the police station with jurisdiction.
5. Items Left Behind that do not fall under any of (1) to (3) above shall be stored for one (1) month from the day the items are recovered and shall be disposed of if the owner has not applied to collect the items during such period.
6. When returning Items Left Behind to the Renter, M2M shall hand over the Items Left Behind to the Renter at the location specified by the M2M.
CHAPTER 11: MISCELLANEOUS PROVISIONS
Article 32: Late Payment Charges
In the event that rental fees or other monetary obligations are not paid when the payment due date has already passed, the Renter shall immediately pay the rental fees and other unpaid amounts together with a late payment charge of 18% per annum for the number of days from the day immediately following the payment due date until the day on which payment is made.
The Renter shall bear all transfer fees and other costs necessary for payment under the preceding paragraph.
Article 33: Rental Suspension
M2M shall reserve the right to temporarily suspend the rental without any prior notification to the Renter for the following reasons:
• Emergency maintenance of the Rental Car, communication network, system, software programs, and other items relating to the rental.
• Fire, power outage, natural disasters such as earthquake, volcanic eruption, flood, tsunami, or telecommunication problems or system errors.
• Warfare, disturbances, riots, civil commotions or strikes.
• System overload or when M2M judges that a security vulnerability exists; or
• When M2M deems that the temporary suspension of the rental is necessary for other operational and technical reasons.
The Renter shall consent to the fact that delay or suspension of the rental may occur for the aforementioned reasons prior to commencing use of the vehicle.
CHAPTER 12: PERSONAL DATA
Article 34: Purposes of Handling of Personal Information
1. The Company shall use the Renter’s or the Driver’s personal information acquired from the Renter and information obtained from use of the Service by the Renter or the Driver (hereinafter referred to as “Usage Information”) for the purposes provided in the following items. Except for reasons authorized by the Personal Data Protection Act and other laws and regulations, personal date and information shall not be used in excess of this scope.
2. For examination when concluding the Rental Agreement, identification, automatic indication of the information of the Renter or the Driver in displays of various applications, provision of reservation and rental services, issuance of rental certificate, settlement of rental fees, record management of vehicle rentals, grant of benefits, and implementation of other transactions (However, when a joint user handles information on the Renter or the Driver for the joint use of information as described in in Paragraph 3, this refers to use within the scope necessary for the content of the contract with the Renter or the Driver and execution thereof);
3. For verification and judgment of membership qualification for the services offered by the M2M and provision propriety of other services.
4. For advertising products, services, privileges, and other information handled by the M2M and its business partners (direct mail, mail magazines, customer support, etc).;
5. For marketing activities for the products and services handled by the M2M and its business partners (questionnaire surveys, promotions, sending of presents, purchase analysis, etc.); and For the execution of other work incidental or relating to the above.
6. M2M shall not provide personal information that it has collected to any third party, except in the following cases:
a. When the individual concerned by the personal information (i.e., the Renter or the Driver) has consented to such provision.
b. When required under laws or regulations.
c. When necessary to protect human life, health, or property, it would be difficult to obtain the consent of the individual concerned.
d. When there is a particular need to do so for purposes of contributing to public health or promoting the sound rearing of children, it would be difficult to obtain the consent of the individual concerned.
e. When it is necessary to cooperate in the performance by a national or local government agency or a party entrusted with authority by such an agency of activities prescribed by laws or regulations and obtaining the consent of the individual concerned could impede the execution of such activities.
f. When entrusting such information to third parties within the scope necessary to achieve the purposes of use.
g. In cases involving succession of business due to a merger or other reason.
h. In the cases described under Paragraphs 3 to 8.
7. The Company may engage in joint use of personal information and Usage Information provided to it. See the Privacy Policy and the policy for the Handling of Personal Information (referred to collectively as “Privacy Policy” hereinafter) published on the Company’s website for information concerning joint use.
8. M2M may handle user information by providing it to and sharing it with its associates who have entered into associates’ agreements with the Company. However, such associates may handle user information within the scope necessary to achieve the purposes of use under Paragraph 1 only when the Renter or the Driver receives provision of a service related to these Terms of Use.
Information (hereinafter referred to as “Usage Information”) acquired through the Renter’ may be used continuously by the Company, the Company shall implement data anonymization so that specific individuals cannot be identified from the Usage Information.
Primary Usage Information
Rental information (vehicle model, date and time, station, mileage, fees, bonuses, promotions, compensation package, options, liabilities from accidents, etc.), information on reservations (method, date and time, changes, cancellations, etc.), Rental Car’s GPS device, dashcam, recorded information of devices installed in the vehicle, etc.
Purpose of use
To improve and enhance services offered by the M2M and its business partners to consider and implement new services of the M2M and its business partners, as well as to establish and maintain infrastructure, and to organize and implement safety management.
Receiving parties
M2M and its business partners, research institution if any.
Means of provision
Sending or transmission by written, electromagnetic, or verbal communication methods (including telephones)
In addition to those provided for in this article, the Company’s initiatives for protecting personal data and information shall be as stipulated in the Privacy Policy published on the Company’s website if applicable. The provisions of the Privacy Policy shall take precedence in the event of any conflict or inconsistency between this Agreement and the Privacy Policy.
Article 35: Amendment of Terms & Conditions
M2M may modify this Agreement and other Terms & Conditions without the prior consent of the Renter by the methods provided for in the following paragraph.
Modification of this Agreement and other Terms & Conditions made pursuant to the preceding paragraph shall become effective on the effective date posted on our homepage or specified in the appropriate way of notice mentioned in the preceding paragraph.
DISCLAIMER
Terms and conditions are a fundamental part of this Agreement and breach to any of the terms hereof can lead to breach of contract. These Terms and Conditions of this Agreement are subject to revision and change by M2M without notice, however, the current Terms and Conditions shall be applicable to an order at the time it is accepted by M2M.
